Removing holiday let planning conditions success!

SF Planning Limited and our client are pleased to achieve planning permission on appeal for the removal of a holiday let planning condition attached to a building just outside Ilfracombe, within North Devon District Council.

Our Grounds of Appeal Statement demonstrated the scheme fully accords with the latest national planning policy objectives within the NPPF, which support rural housing in “non-isolated” locations in principle and also advocate the conversion of rural buildings to residential without the need to consider other uses first. Our planning appeal included analysis of recent holiday let trends in the vicinity as well as recent case law. The scheme was also proven not to have a detrimental impact on the local highway network and will ensure the enhancements made during the conversion of the building are maintained to avoid the existing building falling into disrepair, since it was proven not to be viable as a holiday let.

The Inspector in the appeal decision concluded;

“……the disputed condition is not necessary or reasonable in the light of current development plan policies. Furthermore, an unrestricted residential use would not harm the rural economy, and the site is accessible to local services and facilities by sustainable modes of transport. Taken together, these factors provide the compelling evidence required.”

We also successfully argued the council failed to take into account important material considerations including the type of “unrestricted” residential accommodation the building offers and it was demonstrated the council’s reasons for refusal did not stand up to scrutiny. Our appeal win and the removal of the holiday let planning condition avoided the need for any formal enforcement action from the council towards our Client.
