Planning Permission with Ecological Complexities

This planning application in Tewkesbury Borough was subject to additional complexities due to the presence of great crested newt in the local area.

Permission in principle

Initially, our application was for Permission in Principle which was granted in December 2021. The application sought planning permission for the provision of one self-build dwelling within the village of Apperley, following demolition of an existing outbuilding. 

In recommending the project for approval, the Planning Officer noted the following:

“The benefits which would be derived from the development would be a contribution, albeit in a small way, towards providing housing in the Borough as well as limited economic benefits arising both during and post construction. The proposal would also provide a limited social benefit from future occupiers who would help support facilities and services in Apperley.” 

“The proposal is well related to the existing built development and local services would be accessible on foot. It considered that the adverse impacts would not significantly or demonstrably outweigh the benefits” 

Technical Detail Consent and Protection of the Great Crested Newt

Following the successful PiP application, SF Planning were instructed to submit the Technical Details Consent (TDC) application for the proposal. Before making the submission, we instructed experts to provide the relevant reports to address any potential concerns from the Council – these included the following documents: 

  • Drainage Strategy Technical Note 
  • Ecology Report – Preliminary Roost Assessment 

The TDC application was validated in August 2022, however, concerns were raised regarding the potential of the site as a habitat for great crested newt, given the known presence of the species in the area.  

In order to address these concerns, we instructed a further, detailed ecological appraisal. The resulting ecologist’s report confirmed that great crested newt may pass through the site on occasion. For that reason, a district licence from NatureSpace was required to permit the works. 

This resulted in delays in the determination of the application whilst the additional information was prepared. The GCN district licence was granted in January 2023 and permission was granted in March 2023.  

The Development

The development is for a sensitively designed low-level, contemporary dwelling with associated landscaping, access and parking. By using carefully considered materials, the house will sit sensitively in its surroundings with minimal visual impact. Additionally, the height of the building will follow that of the existing hedge-line. Thus, ensuring the protection of existing views toward the River Severn.
