Affordable housing and vacant building credit at the Court of Appeal

Affordable housing update

UPDATE 11 May 2016: The judgement came through one day early, see our new page

UPDATE 6 May 2016:  We have it on good authority that the judgement on this case will be handed down on 12 May 2016.  We will update this page if/when it happens.

Following on from our article back in August 2015 with regard to the High Court decision on affordable housing and vacant building credit, many of our clients will be aware that the Government challenge to the decision was heard in the Court of Appeal last week.

We understand that the judges indicated that they would rule on the matter after Easter, but we don’t know how long after Easter.  One would hope that it will be soon after given the number of smaller sites currently stalled waiting for some certainty on this matter.

SF Planning has obtained the skeleton arguments for both sides in this case, and it makes for interesting reading:

Councils’ Case

We will update our website as soon as the Court of Appeal judgement is reached.
